Terms and Conditions of Use – My Brazilian Doctor

These Terms and Conditions govern the use of services provided through this website and telemedicine platform. By booking an appointment, using this website, or communicating with the service, you agree to the terms described below.


1. Nature of the Service

My Brazilian Doctor provides online medical consultations (telemedicine) with:

  • Easy access and tailored medical care
  • Online medical prescription valid in pharmacies in Brazil, when clinically appropriate
  • Same-day personalized medical appointments, subject to availability
  • Consultation Summary for possible health insurance reimbursement
  • One follow-up contact related to the initial consultation (see Section 4)

Telemedicine is a regulated medical modality in Brazil and follows Brazilian medical and ethical legislation.


2. User Responsibilities

By using this service, you agree to:

  • Provide accurate, complete, and truthful medical information
  • Inform the doctor about:
  • Current medications
  • Allergies
  • Previous diagnoses
  • Relevant medical history
  • Ensure you are in a private and appropriate environment during the consultation
  • Use prescriptions and medical advice strictly as directed
  • Seek urgent or emergency in-person care when necessary (see Section 7)

Failure to provide accurate information may compromise medical care, and My Brazilian Doctor cannot be held responsible for consequences arising from omitted or incorrect information.


3. Telemedicine Limitations

According to Brazilian medical legislation, telemedicine cannot be applied to all medical conditions.

The physician has full professional autonomy to decide:

  • Whether a condition can be managed via telemedicine
  • Whether in-person evaluation, exams, or emergency care are required

If the doctor determines telemedicine is not appropriate, the consultation may be redirected to in-person care without this constituting service failure.


4. Follow-Up Policy

Each consultation includes one follow-up contact, if medically appropriate.

  • The follow-up must relate directly to the initial consultation
  • The follow-up request must be made within 10 days of the original appointment
  • Once requested, the follow-up contact will be scheduled within 24 hours
  • The follow-up interaction must occur within 10 days of the original consultation date

If further medical assistance is needed beyond this follow-up, a new consultation must be booked, with the corresponding service fee.


5. Communication Policy

  • Emails and messages are replied to within 24 hours (business days)
  • Communication channels are intended for medical support related to active consultations
  • Messages do not replace emergency medical services


6. Payments and Fees

  • The standard service fee is USD 60.00 per consultation, unless otherwise stated
  • Payment is required at the time of booking to confirm the appointment
  • Prices may change without prior notice but do not affect already confirmed bookings


7. Refunds

Refunds are not guaranteed and are evaluated case-by-case.

Refunds are generally not provided when:

  • The consultation has already taken place
  • Medical guidance and documentation have been delivered
  • The patient chooses not to follow medical advice

If technical failure from the provider prevents the consultation from occurring, rescheduling or refund may be offered.


8. Rescheduling and Cancellations

After booking, users receive a secure email link to manage their appointment.

  • Appointments can be rescheduled or canceled without penalties
  • No-show situations (missing an appointment without prior contact) are evaluated individually before allowing rescheduling


9. Emergency Situations

This service is not an emergency service.

If you experience symptoms such as:

  • Chest pain
  • Severe breathing difficulty
  • Loss of consciousness
  • Seizures
  • Severe bleeding
  • Signs of stroke

You must immediately seek local emergency medical care.


10. Data Usage and Privacy

By using the service, you consent to the collection and use of personal and medical data for:

  • Providing medical care
  • Medical documentation
  • Legal and regulatory compliance
  • Service improvement

Medical data is treated as confidential health information and handled according to:

  • Brazilian data protection laws
  • Medical confidentiality and ethical standards

Data is never sold. Information may be shared only when legally required or for patient safety.


11. Limitation of Liability

My Brazilian Doctor and its medical professional are not liable for:

  • Outcomes resulting from inaccurate or incomplete patient information
  • Failure to follow medical instructions
  • Delays caused by internet or technical issues outside provider control
  • Medical conditions that require in-person care but are not disclosed or identifiable remotely

Telemedicine involves inherent limitations compared to physical examination.


12. Dispute Resolution

Any dispute related to these services shall be:

  1. First addressed through direct communication with the service
  2. If unresolved, governed by Brazilian law
  3. Subject to the jurisdiction of Brazilian courts, where applicable


13. Acceptance of Terms

By booking and attending a consultation, you confirm that you:

  • Understand telemedicine limitations
  • Accept these Terms and Conditions
  • Consent to medical care delivered via telemedicine
